Changing the Judiciary

I get a lot of mail from fathers wanting me to go over their cases. My view should have gotten over more clearly. That is my fault.

Feminism has destroyed the uniqueness of Anglo-American law and the Supreme Court, liberals and conservatives have done little to hold back the waters of deconstructionist law promoted by obsessive extremists like Catherine McKinnon who would resolve the claims between freedom of speech and gender bellyaching in favor the latter.

I have little use for cases. I use sociological materials that Justice Brandeis first incorporated into U.S. law. It may have some very bad effects, but as long as it is there, I use it for my purposes. I try to turn individual cases into public policy discussions.

But I go farther. I think it a waste of time to try to grasp and convince the minds of judges. I think we ought to knock off a few incumbents in primaries and then not bother to run in the general election. We should put state legislators on notice that each year we will pick a candidate. Unless I am way off base, they will start doing our business without any arguments on our side.

The gender battle is just that. It is not about words. It is not a misunderstanding. It is about raw power. It is much easier to change the judiciary through the political process than by legal research.
